Plaintiff was a passenger aboard a bus. The driver of the bus fell asleep, veered off the road, struck a guardrail so violently that it ripped approximately 200 feet of it from the ground, overturned and rolled down an embankment until it came to a stop on its side, on top of a fence line. Plaintiff, along with several other passengers, was ejected during the rollover and the driver was killed. Plaintiff sustained serious and permanent injuries, both physically and emotionally, including spinal fracture at that resulted in fusion surgery.
