Dangerous Instrumentality

An officer of an Arizona company negligently entrusted a 1929 Ford roadster with a high performance engine that generated in excess of 800 horsepower to one of its employees. The employee had a history of various driving infractions on numerous city streets in company vehicles as well as his own. The employee negligently operated the vehicle on Arizona city streets and lost control at approximately 70mph, crossed the centerline, and collided head-on with Plaintiff’s vehicle. The employee was killed and Plaintiff sustained life-threatening injuries including a closed-head injury.

Defective Seatbelt Design/Improper Airbag Deployment

Plaintiff was a seat belted passenger in a vehicle that struck a horse at night on the highway. The defective restraint system allowed Plaintiff to come in contact with the airbag, which deployed late in the accident sequence. The late deployment of the airbag rendered Plaintiff a quadriplegic.

Negligence/Child Molestation

Plaintiffs were children at an elementary school who were molested by the school counselor. The employee, as a counselor, was placed in a position of trust and confidence with the students. The counselor abused his position by gaining the trust and confidence of young male students and then manipulating this trust and confidence in order to sexually abuse and molest them. The elementary school failed to conduct a proper background check of the employee and failed to report allegations of abuse when notified.

Bus Accident

Plaintiff was a passenger aboard a bus. The driver of the bus fell asleep, veered off the road, struck a guardrail so violently that it ripped approximately 200 feet of it from the ground, overturned and rolled down an embankment until it came to a stop on its side, on top of a fence line. Plaintiff, along with several other passengers, was ejected during the rollover and the driver was killed. Plaintiff sustained serious and permanent injuries, both physically and emotionally, including spinal fracture at that resulted in fusion surgery.

Plaintiff, an Arizona police officer, was involved in an automobile accident when a motorist ran a red light and collided with the officer’s vehicle. The officer sustained serious injuries, including a cervical fracture, which required fusion of C1 through C3 and was no longer able to perform his duties as an officer.

Legal Malpractice

Plaintiffs were seriously injured in an automobile accident with a motorist driving a vehicle owned by the City of Tolleson. Plaintiffs retained counsel and were represented in their claim against the City of Tolleson and its employee for negligence. The attorney for Plaintiffs failed to file the complaint against the governmental entity within the one-year of the date of the accident, as required by the statute of limitations, and the lawsuit was subsequently dismissed.

Tire Tread Separation

Plaintiff was a passenger in a 1995 Honda Passport, which incurred a tread separation to the vehicle’s right front tire resulting in a flat. After changing the tire and resuming travel, ten minutes later the vehicle incurred another tread separation to the left rear tire resulting in the vehicle veering left off the roadway and rotating clockwise until it ultimately rolled several times. During the rollover, the vehicle sustained substantial damage and Plaintiff was ejected from the vehicle and died. Plaintiff’s wife filed a lawsuit alleging the defective design and manufacturing of the tires caused the tread separation.

Medical Malpractice/Medication Error

Plaintiff, a 19-year-old male, underwent arthroscopic knee surgery for a torn Anterior Cruciate Ligament (ACL). The surgery took place in the morning and by 1:00 p.m. he was in recovery, awake and alert. He visited with family and friends until visiting hours were over and was kept overnight for observation and pain management. He received medication from a female nurse at 8:30 p.m. and then again by a male nurse at 9:15 p.m. At 11:30 p.m. he was examined and vital statistics were taken by the male nurse; he was reportedly resting comfortably. At 12:55 a.m. he was found unresponsive by the female nurse. CPR was initiated, but unsuccessful. Plaintiff died as a result of an anaphylactic reaction and the parents filed suit alleging a medication error.
