Plaintiff was a passenger in a 1995 Honda Passport, which incurred a tread separation to the vehicle’s right front tire resulting in a flat. After changing the tire and resuming travel, ten minutes later the vehicle incurred another tread separation to the left rear tire resulting in the vehicle veering left off the roadway and rotating clockwise until it ultimately rolled several times. During the rollover, the vehicle sustained substantial damage and Plaintiff was ejected from the vehicle and died. Plaintiff’s wife filed a lawsuit alleging the defective design and manufacturing of the tires caused the tread separation.
