Dangerous Instrumentality

An officer of an Arizona company negligently entrusted a 1929 Ford roadster with a high performance engine that generated in excess of 800 horsepower to one of its employees. The employee had a history of various driving infractions on numerous city streets in company vehicles as well as his own. The employee negligently operated the vehicle on Arizona city streets and lost control at approximately 70mph, crossed the centerline, and collided head-on with Plaintiff’s vehicle. The employee was killed and Plaintiff sustained life-threatening injuries including a closed-head injury.
