Plaintiffs were children at an elementary school who were molested by the school counselor. The employee, as a counselor, was placed in a position of trust and confidence with the students. The counselor abused his position by gaining the trust and confidence of young male students and then manipulating this trust and confidence in order to sexually abuse and molest them. The elementary school failed to conduct a proper background check of the employee and failed to report allegations of abuse when notified.
